Terms & Conditions — Nursing Care Services

These Terms & Conditions (“Terms”) govern the booking and provision of Nursing Care Services (“Services”) offered by CubNesto LLP (“CubNesto”, “we”, “us” or “our”) to the patient, patient's family member, attendant or authorised representative (“Client”, “you” or “your”).

By booking or using our Nursing Care Services, you acknowledge that you have read, understood and agreed to these Terms.

1. Nature of Nursing Services

CubNesto provides home-based nursing support through qualified/appropriately engaged nursing personnel for services within the scope of the nurse's qualifications, experience, applicable instructions and the services booked by the Client.

Services may include, subject to suitability and applicable clinical instructions:

  • Nursing visits and vital checks
  • Prescribed IM / IV / SC injections
  • Prescribed IV fluids or antibiotic administration
  • Wound and dressing care
  • Catheter insertion, replacement or removal
  • Urine bag replacement
  • Nebulization
  • Prescribed oxygen therapy support
  • Tracheostomy care
  • Tube-feeding support as prescribed
  • Post-operative nursing support
  • Surgical discharge support
  • Elderly and specialised nursing support
  • Short-term and long-duration home nursing

The availability of any particular service depends on the patient's condition, the nurse's scope of practice, the information provided by the Client and the clinical requirements of the case.

2. Nursing Care Is Not a Substitute for Medical Treatment

CubNesto's nursing service is intended to provide home-based nursing support and assistance with an existing care plan.

CubNesto does not replace the treating doctor, hospital, surgeon or other treating healthcare professional.

Our nursing personnel do not independently:

  • Diagnose medical conditions
  • Prescribe medicines or treatment
  • Change a doctor's prescription
  • Determine or alter medication dosage
  • Decide that a prescribed treatment should be started, stopped or changed
  • Replace emergency medical services
  • Provide medical opinions outside their professional scope

Where a procedure or treatment requires a prescription, doctor's order, discharge instruction or other clinical direction, the Client is responsible for providing the relevant and valid instructions before the service is undertaken.

3. Patient Information and Medical Instructions

The Client must provide complete and accurate information regarding the patient's:

  • Medical condition
  • Recent surgery or hospitalisation
  • Allergies
  • Current medicines
  • Existing medical devices
  • Relevant medical history
  • Doctor's instructions
  • Discharge summary
  • Prescriptions and treatment plan
  • Any known risks or complications

CubNesto and/or the assigned nurse may decline, postpone or discontinue a service where the information provided is incomplete, the patient's condition appears unsuitable for the requested service, the required prescription/instruction is unavailable, or the procedure falls outside the nurse's permissible scope.

4. Prescriptions and Doctor's Instructions

For services involving medicines, injections, IV therapy, antibiotics, oxygen, nebulization, tube feeding or other prescribed treatment, the Client must provide the applicable prescription or treatment instructions wherever required.

The nurse will follow the available and applicable clinical instructions and will not independently alter the prescribed treatment.

If there is any uncertainty, inconsistency or concern regarding a prescription or treatment instruction, the service may be paused until clarification is obtained from the treating healthcare professional.

5. Medicines, Medical Supplies, Consumables and Equipment

CubNesto does not routinely provide medicines, medical supplies, consumables, kits or medical equipment as part of the nursing service.

Unless specifically agreed in writing as part of a separate service or package, the Client/patient is responsible for arranging and making available all items required for the booked procedure, including, where applicable:

  • Medicines and injections
  • IV fluids and prescribed medications
  • Syringes and needles
  • IV sets, cannulas and related consumables
  • Catheters and urine bags
  • Dressing materials
  • Gauze, bandages and wound-care materials
  • Gloves and other disposable items
  • Nebulizer machine and accessories
  • Oxygen cylinder/concentrator and accessories
  • Feeding tubes and feeding supplies
  • Tracheostomy-related supplies
  • Any other prescribed medical device, consumable or equipment

The nursing service fee does not include the cost of these items unless expressly stated otherwise on the applicable booking or invoice.

CubNesto will not be responsible for the quality, suitability, expiry, storage, availability or authenticity of medicines, devices or consumables purchased or supplied by the Client or a third party.

6. Patient Safety and Emergency Situations

Home nursing is not an emergency medical service.

If the patient experiences an emergency, sudden deterioration or a condition requiring immediate medical attention, the Client/attendant should contact the appropriate emergency medical service or treating hospital without delay.

Depending on the circumstances, the assigned nurse may advise the Client to seek immediate medical attention or emergency transfer.

CubNesto does not guarantee the prevention of medical complications, deterioration, hospitalisation or other clinical outcomes.

7. Service Assessment and Nurse Assignment

Before deployment, CubNesto may collect information about the patient's condition, care requirements, service duration and requested procedures to determine whether the requested service can reasonably be supported.

The assigned nurse may be changed where required because of:

  • Availability
  • Skill or experience requirements
  • Patient-care requirements
  • Leave or unforeseen circumstances
  • Safety considerations
  • Operational requirements

A request for a particular nurse does not guarantee that the same nurse will remain assigned throughout the entire service period.

8. Service Hours and Attendance

The Client must provide the nurse with reasonable and safe access to the patient's home during the booked service hours.

The booked service period begins and ends according to the agreed schedule.

Any additional hours, extended visits or additional procedures outside the booked service will be charged separately where applicable.

Client-requested changes to location, shift timing or service requirements may require reassessment and may result in revised charges.

9. Home Environment and Safety

The Client is responsible for maintaining a reasonably safe and suitable environment for the nurse and patient.

CubNesto may refuse or discontinue a deployment where the working environment presents a serious or unreasonable safety risk to the patient, nurse or other persons.

The nursing service does not include general household work, cleaning, cooking, laundry, errands or unrelated domestic responsibilities unless expressly included in a separately agreed service.

10. Scope of Nursing Procedures

A listed service does not mean that every patient is automatically suitable for that procedure.

The actual service provided will depend upon:

  • The patient's condition
  • Applicable prescription or clinical instructions
  • Nurse's qualifications and permissible scope
  • Available equipment and supplies
  • Safety considerations
  • The circumstances at the time of service

CubNesto reserves the right to decline a procedure where it cannot reasonably be performed safely or within the applicable professional scope.

11. Post-Operative and Surgical Discharge Support

For patients discharged after surgery, CubNesto may provide nursing support at home based on the discharge instructions and care plan provided by the treating hospital or doctor.

Such support may include wound/dressing care, vital monitoring, prescribed nursing procedures, catheter-related care, tube-feeding support and other applicable nursing services.

CubNesto does not assume responsibility for the surgical procedure, diagnosis, medical decision-making or treatment plan provided by the hospital or treating doctor.

12. Tube Feeding

Where tube feeding is part of the booked service, the nurse will provide support according to the prescribed feeding plan and instructions available from the treating healthcare professional.

The Client is responsible for providing the prescribed feed, feeding tube and other required supplies unless specifically agreed otherwise.

CubNesto does not independently prescribe the type, quantity, frequency or nutritional composition of tube feeds.

13. Wound Care

Wound and dressing services are provided according to the available medical instructions and the nature of the wound.

The Client is responsible for providing prescribed dressing materials and consumables unless expressly included in the booking.

If the nurse observes signs requiring medical review, the Client may be advised to contact the treating doctor or seek medical attention.

14. Service Limitations

CubNesto does not guarantee any particular medical or recovery outcome.

Nursing support is provided to assist with the patient's prescribed care requirements and does not guarantee:

  • Faster recovery
  • Prevention of infection
  • Prevention of complications
  • Avoidance of hospitalisation
  • Complete healing of wounds
  • Improvement in the underlying medical condition
  • Any specific clinical outcome

15. Biomedical Waste Management

The Client is responsible for ensuring the proper segregation, storage, handling and disposal of biomedical waste generated at the patient's premises, including used needles, syringes, dressings, gauze, gloves and other contaminated or disposable medical materials, in accordance with applicable laws, rules and local requirements.

Unless expressly agreed otherwise in writing, CubNesto does not provide biomedical waste collection, transportation or disposal services and does not provide biomedical waste disposal kits or containers.

The Client is responsible for arranging appropriate biomedical waste disposal facilities, containers or collection services, where required.

The nursing professional may follow reasonable safety precautions while performing the assigned nursing procedure; however, the responsibility for arranging compliant biomedical waste disposal at the premises remains with the Client, subject to applicable law.

CubNesto may decline or discontinue a procedure where appropriate waste-disposal arrangements are not available and proceeding would create an unreasonable safety or compliance risk.

16. Fees and Payment

Service fees are based on the applicable price displayed or communicated by CubNesto at the time of booking.

Additional charges may apply for:

  • Additional service hours
  • Services outside the booked scope
  • Changes in service requirements
  • Additional visits or procedures
  • Applicable taxes
  • Other charges expressly communicated before the service is provided

The Client agrees to make payment according to the applicable booking and payment terms.

17. Privacy and Patient Information

Information provided by the Client relating to the patient may be used for:

  • Assessing service requirements
  • Scheduling and deployment
  • Nursing coordination
  • Service documentation
  • Customer support
  • Billing and payment
  • Internal quality and operational purposes
  • Compliance with applicable legal requirements

CubNesto will handle personal and patient information in accordance with applicable law and its privacy policy.

18. Client Responsibilities

The Client agrees to:

  1. Provide accurate and complete patient information.
  2. Provide valid prescriptions/discharge instructions where required.
  3. Make required medicines, consumables and equipment available.
  4. Inform CubNesto of any change in the patient's condition.
  5. Follow instructions given by the treating doctor and healthcare team.
  6. Maintain a safe working environment.
  7. Treat the nursing professional respectfully.
  8. Make payments within the agreed timelines.

19. Unauthorised Use of Nursing Personnel

Nursing personnel assigned through CubNesto are deployed for the agreed nursing services.

The Client should not require, instruct or pressure the nurse to:

  • Perform procedures outside the agreed scope
  • Administer medicines without appropriate instructions
  • Perform household duties unrelated to nursing care
  • Undertake unsafe activities
  • Perform services for which the nurse is not appropriately qualified or authorised

20. Right to Refuse or Discontinue Service

CubNesto or the assigned nursing professional may refuse, pause or discontinue a service where:

  • The requested procedure is outside the applicable scope
  • Required medical instructions are unavailable
  • Necessary supplies or equipment are unavailable
  • The patient's condition requires hospital or emergency care
  • The environment is unsafe
  • The Client requests an unsafe or unauthorised procedure
  • There is abusive, threatening or inappropriate behaviour towards the nursing professional

Where reasonably possible, the Client will be informed of the reason and advised to seek appropriate medical assistance.

21. Third-Party Medical Providers

Where the patient's treating doctor, hospital, physiotherapist, dietitian or another healthcare professional provides medical instructions, CubNesto's nursing personnel may support implementation of those instructions within their applicable scope.

CubNesto does not assume responsibility for the independent diagnosis, prescription, surgery, treatment plan or clinical decisions of third-party healthcare professionals.

22. Changes to Services and Terms

CubNesto may update its services, prices, availability and these Terms from time to time.

The applicable Terms will be those in effect at the time of the relevant booking, subject to applicable law.

23. Governing Law

These Terms shall be governed by the applicable laws of India.

Any dispute arising from the Services shall be subject to the jurisdiction of the courts having appropriate jurisdiction over the matter, subject to applicable law.
